The Office of the Council of Ministers,

• having seen the Constitution of the State of Cambodia;
• having seen the law on the office of personnel and on the activities of the Office of the Council of Ministers that declared the enforcement of Decree No. 3 dated February 10, 1982;
• having seen the law dated January 31, 1992 on the modification of the Office of the Council of Ministers and the Ministry of Planning,;
• having seen the Decree Law No. 7 dated July 13, 1982 on the competences and procedures for drafting laws and regulations;
• having seen Anukret No. 1 dated January 11, 1991 on overtime, educational allowances for teachers and allowances for the care of children granted to kindergarten school teachers ;
• having seen Anukret No. 2 dated March 13, 1991 amending Article 2 of Anukret No.1 dated January 11, 1991 on overtime, educational allowances for teachers and allowances for the care of children granted to kindergarten school teachers;
• having seen the Decision of the Office of Council of Ministers No. 89 dated October 10, 1983 and No. 122 dated July 11, 1984 on the wage schemes of personnel and workers of the State;

according to the proposal of the Minister of the Planning;

decides:

 Article 1:

The payscales "AI" "AII" "AIII" "B" and "C" defined by the Decision of the Council of Ministers No. 89 dated October 10, 1983 and No. 122 dated July 11, 1984 under the system of salaries for civil servants and State workers determine the new value of wages following each category and scale as prescribed in the Annexes herein attached.

The above-mentioned payscales include compensation for 9 categories of the following goods: rice, oil, cigarettes, white sugar, milk, dry fish, salt, soap and cloth, and water and electricity expenses.

Article 2:

Concerning family benefits due to civil servants and State workers, there shall only be preserved the allowances supporting children and women.

• 2,500 Riels per month for each child
• 3,000 Riels per month for the spouse

Article 3:

The education allowance and the allowance for expenses for child health care rendered by mistresses of kindergarten schools shall be established as follows:

(i) Educational allowance:

(ii) Expenses for child health care rendered by kindergarten schoolteachers: 500 Riels (each) per month.

Article 4:

The rate for overtime and compensation for health for civil servants and State workers shall be fixed as follows:

(i) Rate for overtime:

a) For civil servants and workers in general;

• overtime during the day shall be fixed at 100% of the basic wage;
• overtime during the night shall be fixed at 150% of the basic wage;

b) For instructors:

(ii) Compensation for health care:

• 1,500 Riels per month for the one who previously received 20% of his/her health care compensation;
• 1,000 Riels per month for the one who previously received 15% of his/her health care compensation;
• 500 Riels per month for the one who previously received 10% of his/her health care compensation;

Article 5:

Zone and mission benefits shall be fixed as follows:

(i) Zone Benefit: 1,500 Riels per month, which replaces the previous benefits, for agents working in remote areas.

(ii) Position Benefit:

(a) The position benefit for civil servants managing hospitals and schools:

(b) Position benefit for highly ranked driver:

• 1,500 Riels per month for the agent having received 30% of the previous position benefit;
• 1,100 Riels per month for the agent having received 20% of the previous position benefit;
• 1,000 Riels per month for the agent having received 15% of the previous position benefit.

Article 6:

The Ministry of Planning shall control, in the markets of Phnom Penh, the price of goods mentioned in the Annex to this Anukret. When there will be a price increase of an average of 10%, the Ministry of Planning shall publish the amount of money that shall be added to the wages in proportion with this price increase.

Article 7:

The retirement pension and the monthly disability pension for retired civil servants and the disabled shall be calculated following the new wage scales of Tables AI, AII, AIII, B and C mentioned in Article 1.

Articles 8:

The pension of a civil servant who voluntarily requests the cessation of his/her civil service shall be fixed to an amount equal to the wage and the monthly benefits of this civil servant, multiplied by the number of years where he/her has rendered his/her services to the State of Cambodia.

This pension shall be equal to a minimum of 3 months of wages for a civil servant having served in his/her position for more than one year and up to a maximum of 10 months of wages for a civil servant having served in his/her position for more than 10 years. It does not apply to the civil servants that have requested their retirement or their disability pension, that have left their functions without approval of the ministry, the province or the municipality, nor to civil servants having ceased their service due to disciplinary measures imposed by the ministry, the province or the municipality.

Article 9:

The Ministry of Planning and concerned ministries shall publish an instruction on the implementation of this Anukret.

Article 10:

The Minister in charge of the Office of the Council of Ministers, the Minister of Planning, the Minister of Economy and Finance, the other Ministers and the municipal and provincial popular committees shall be responsible for the enforcement of this Anukret.

Article 11:

Provisions conflicting with this Anukret shall be abrogated.

Article 12:

This Anukret shall take effect as of April 1, 1992.
