KRET DATED FEBRUARY 19, 1995
ESTABLISHING THE SUPREME COUNCIL ON NATIONAL CULTURE

- Having seen the Constitution of the Kingdom of Cambodia;
- Having seen the Kret of His Majesty the King of Cambodia Samdech Preach Norodom Sihanouk Varman dated November 1, 1993 on the Appointment of the Royal Government;
- Having seen the Kret dated October 24, 1993 on the Appointment of the First Prime Minister and the Second Prime Minister;
- Having seen the Decision 25/SSR dated August 27, 1993 of the Provisional Government of Cambodia concerning the Establishment of the Supreme Council on National Culture;
- Having seen the Kret 1/NS dated May 1994 concerning the Zoning and Management of the Region of Siem Reap/Angkor;
Pursuant to the proposal of the two Prime Ministers, and the Senior Minister for Culture and Fine Arts, Land Use Planning, Urbanization and Constructions, approved by the Council of Ministers at its plenary meeting on January 27, 1995;
It is hereby ordered:
Article 1:
The new membership of the Supreme Council on National Culture, established by Decision No. 25/SSR of 27 August 1993 of the Provisional Government of Cambodia, shall be as follows:
- the First Prime Minister, Co-President
- the Second Prime Minister, Co-President
- the Senior Minister for Culture and Fine Arts, Land Use Planning, Urbanization and Constructions, or his representative, Vice-President
- the Minister of Public Works and Transport, or his representative, member
- the Minister of the Economy and Finance, or his representative, member
- the Minister of Culture and Fine Arts, or his representative, member
- the Minister of Foreign Affairs and International Cooperation, or his representative, member
- the Minister of Tourism, or his representative, member
- the Minister of the Environment, or his representative, member
- the Minister of Planning, or his representative, member
- the Secretary-General of the Cambodian Development Council, or his representative, member
- the Governor of the province of Siem Reap, or his representative, member
- a Representative of the Office of the Council of Ministers member
Article 2:
The Supreme Council on National Culture may, if necessary, invite ministries, representatives of the National Assembly and representatives of national and international institutions whose activities concern the field of national culture to participate in its work.
Article 3:
The Supreme Council on National Culture is in charge of:
- examining cultural sites and historic monuments and listing them as national cultural heritage;
- protecting historic cultural property and antiquities of a physical nature;
- administering and controlling the regions where listed monuments are situated, together with the collections of art objects associated with them;
- delivering authorizations for all archaeological research, conservation works and any other activities concerning monumental sites and other cultural property of the Nation;
- administering these historic sites in order to protect the national heritage.
To this end, it is necessary to:
- draw up a policy for the enhancement of the heritage;
- organize facilities to allow the public access to the heritage;
- appoint supervisory and other staff to carry out this work;
- organize a tourist network;
- promoting cultural values, mobilizing the necessary funds, educating the public, training, and carrying out research on the physical cultural and historic heritage;
- providing guarantees concerning the management responsibilities and obligations laid down by the cultural conventions and other normative instruments to which Cambodia is party;
- taking the necessary steps to execute projects and any other action relating to the protection, preservation, restoration, and enhancement of the national heritage.
Article 4:
The members of the Supreme Council on National Culture shall meet at the invitation of the Co-Presidents.
Article 5:
The Co-Presidents of the Supreme Council on National Culture shall establish a permanent secretariat at the Ministry of Culture and Fine Arts. This secretariat shall be directed by the Minister of Culture and Fine Arts.
Article 6:
The Supreme Council on National Culture shall use the seal of the Council of Ministers.
Article 7:
The rules of procedure of the Supreme Council on National Culture shall be defined by Anukret.
Article 8:
The First Prime Minister, the Second Prime Minister, and the Ministers concerned shall be responsible for the execution of the present Kret.
Article 9:
The present Kret shall come into effect from the date of its signature.
