ANUKRET on
The Organization and Functioning of the Ministry of
Agriculture, Forestry and Fisheries

Pursuant to
the approval of Council of Ministers at its plenary session on March 24, 2000
Article 1:
This Anukret determines the organization of the Ministry of Agriculture, Forestry and Fisheries’ entities and the missions of the general departments, general inspectorate, and locally based entities of the Kingdom of Cambodia.
Article 2:
The Ministry of Agriculture, Forestry and Fisheries is delegated by the Royal Government to perform the guiding and administrative mission over the agricultural field of the Kingdom of Cambodia.
Article 3:
The Ministry of Agriculture, Forestry and Fisheries has the following functions and duties:
- To prepare and implement agricultural development policies to promote the living standard of citizens;
- To participate in the preparation of policies for reform and use of land;
- To instruct and develop plans for agricultural development;
- To coordinate, follow up, and evaluate the policy implementation and agricultural development activities;
- To monitor the evolution of natural resources of the agricultural field and facilitate such natural resource business to meet the needs of the Kingdom and maintain ecological equilibrium;
- To define provisions for governing, preserving, and protecting natural resources of the agricultural field and follow up its implementation;
- To conduct assessments and human resources training for participation in agricultural development by promoting the technical understanding and increasing the effective use of such resources;
- To provide advocacy and necessary technical guidance for farmers to promote agricultural production and productivity;
- To define policies and follow up the performance and promote and improve the functioning of vocational agencies and associations dealing with agriculture;
- To research and disseminate scientific and economic technologies in all agricultural sectors;
- To instruct on land development and land quality improvement and proper use of agricultural land, seedlings, breeding, chemical fertilizers, and agricultural chemicals based on the geographical situation and regional weather to obtain high yields and maintain the natural environment;
- To conduct cooperation at national and international levels with international and non-governmental organizations for all sectors of agricultural development;
- To participate in encouraging and promoting investments, and exportation of agricultural products and food;
- To participate in implementing missions related to the Mekong river under the ministry's jurisdiction;
- To participate in the preparation of price policies and find markets for agricultural products;
- To collect revenues and pay to the State budget or cooperate with the Ministry of Economy and Finance to collect revenues for the State; and
- To conduct other activities assigned by the Royal Government.
Article 4:
The Ministry of Agriculture, Forestry and Fisheries consists of the following structures:
A - Central Entities:
- Cabinet of Minister;
- General Inspectorate;
- Ministerial General Departments.
The ministerial general departments consist of 12 departments as follows:
- Department of Administration;
- Department of Accounting and Finance;
- Department of Planning, Statistics, and International Cooperation;
- Department of Personnel and Human Resource Development;
- Department of Agricultural Legislation;
- Department of Agronomy and Land Improvement;
- Department of Agro-Industry;
- Department of Production and Veterinary;
- Department of Agricultural Dissemination;
- Department of Agricultural Machinery;
- Department of Forestry;
- Department of Fisheries;
- General Department of Rubber Plantation.
This general department consists of two subordinate departments as the following:
- Department of Rubber Development; and
- Department of Marketing and Cooperation.
B – Locally based entities:
- Provincial and municipal agricultural, forestry and fisheries offices.
C – Public establishments:
The entities subject to technical supervision of the Ministry of Agriculture, Forestry and Fisheries that are currently implementing their specialized skills, including:
- Royal University of Agriculture;
- Cambodian Institute of Agricultural Research and Development;
- Prek Leap Agriculture School;
- Kampong Cham Agriculture School;
- Agricultural Materials Company;
- Rubber Development Company;
- Cambodian Institute of Rubber Research;
- Import/Export and Rubber Equipment Transport Company;
- There are seven rubber plantation companies, they are: Chup rubber plantation, Krek rubber plantation, Memot rubber plantation, Snuol rubber plantation, Chamcar Andoung rubber plantation, Boeng Ket rubber plantation, and Peam Chaing rubber plantation.
The organization chart of the Ministry of Agriculture, Forestry and Fisheries is an annex to this Anukret.
Article 5:
The cabinet of minister is in charge of undertaking missions that are determined by the provision of Anukret 20/ANKr-BK, dated April 30, 1996 as referred to above, concerning the organization and functioning of Ministries and State Secretariats.
Article 6:
The General Inspectorate shall act as a mechanism of the ministry for the following activities:
- To conduct a regular inspection to all entities under the Ministry of Agriculture, Forestry and Fisheries’ jurisdiction;
- To prepare reports to the Minister on the functioning of entities that have been inspected and about measures for improving such functioning; and
- To perform other duties assigned by the Minister.
The General Inspectorate shall be headed by one General Inspector and assisted by a deputy general director, if necessary.
Article 7:
The Ministerial General Departments shall function as ministerial mechanisms for the following activities:
- To coordinate and follow up all activities of the central entities, locally based entities and public establishments under the Ministry's supervisory and facilitate to achieve goals defined in the agricultural development policies;
- To harmonize general laws and regulations, directives related to agricultural fields organized by the entities under the Ministry's supervision;
- To coordinate all activities with the ministerial entities and with other entities related to administration, assessment, reporting, filing documentation, staffing, planning, finance, and material equipment;
- To organize and develop the strategic policies, plans, and agricultural development programs;
- To coordinate all ministerial activities with other ministries and institutions and international cooperation;
- To prepare and write draft laws and other regulatory texts related to agriculture; and
- To perform other duties assigned by the leadership.
This Ministerial General Department consists of 12 subordinate departments as provided for in the Article below.
Each department shall be headed by one director and assisted by a number of deputy directors, if necessary.
Article 8:
The Department of Administration shall have the following roles:
- To coordinate administrative management at the central level and between locally-based entities under its jurisdiction;
- To manage and circulate administrative documents of the ministry;
- To ensure the administrative efficiency and safety and social affairs and protocols of the ministry;
- To conduct needs assessments, make programs for expense, management, use, and maintenance of vehicles, materials and equipment of the ministerial entities;
- To conclude and make achievement and activity reports of the ministry;
- To maintain files and records; and
- To perform other duties assigned by the ministry leadership.
Article 9:
The Department of Accounting and Finance shall have the following roles:
- To gather and adjust the budget chapters;
- To propose the ministry budget plan and follow up its operation;
- To maintain accounting records and books;
- To manage the costing account of public procurement performance;
- To manage information technology, financial activities, and costing accounts;
- To conduct technical inspection over public procurement transactions;
- To assess the need for and coordinate all ministerial expenditures;
- To properly collect revenues under the Law on Financial Management;
- To follow up and recommend the management of special accounts;
- To manage movable and immovable property, material stock, make inventory lists;
- To receive and distribute equipment to entities under its supervision;
- To regularly maintain employment forms and physical accounts;
- To prepare annual financial reports of the Ministry; and
- To perform other duties assigned by the leadership.
Article 10:
The Department of Planning, Statistics, and International Cooperation shall have the following roles:
- To analyze and make short term, medium term and long-term agricultural development plans and follow up their implementation;
- To administer general and partial observations over agricultural fields, collect information and agricultural statistics, and analyze, evaluate and compile documents;
- To prepare and develop strategic policies and agricultural development programs and determine the goals for such development;
- To prepare and develop public investment projects and instruct private investment projects related to agriculture and development programs for food support;
- To research and disseminate prices for farm crops and the need for agricultural products in local and international markets to facilitate the farmers in the selection of their production;
- To manage a center for technical and scientific agricultural documentation;
- To establish collaboration with other institutions and international cooperation in investments and projects related to agriculture;
- To perform other duties as assigned by the leadership.
Article 11:
The Department of Personnel and Human Resource Development shall have the following roles:
- To administer civil servants and ministerial public agents by liaison with the State Secretariat for Civil Service;
- To prepare administrative papers for career management;
- To prepare statistics of staff management and schedule of activities;
- To develop programs for professional positions and human resources in the ministry;
- To prepare payroll, labor (employment), wage and support;
- To conduct needs assessments for staff development training, and review and send expert officials to go through improvement courses or continue studies inside or outside the Kingdom;
- To organize preliminary and intermediate training policies through liaison with the State Secretariat for Civil Service and implement such policy;
- To cooperate with entities and institutes of agricultural technical studies to participate in development of curricula and mandates of such entities for training to meet social development needs;
- To propose the formation and dissolution of entities, arrange functions, roles, and restructuring due to practical situations; and
- To perform other duties assigned by the leadership.
Article 12:
The Department of Agricultural Legislation shall have the following roles:
- To design policies for farmers, including disadvantaged farmer to improve their socio-economic status in the market economy;
- To develop legal conditions, propose measures and facilitate the development of entities and agricultural organizations;
- To prepare and review draft laws, regulations, and directives at the request of departments or subordinate entities under the laws in force;
- To disseminate and follow up implementation of legal texts, provisions, and regulatory texts related to agriculture fields for departments and relevant institutions;
- To register and design quality standards based on specifications for agricultural equipment and improve inspection measures for agricultural equipment;
- To act as legal assistant on agricultural matters for ministerial leadership and entities under the ministry's supervision; and
- To perform other duties as assigned by the leadership.
Article 13:
The Department of Agronomy and Agricultural Land Improvement shall have the following roles:
- To design policies, plans, programs, projects and measure for production development;
- To prepare land inventories and categorize land;
- To follow up other farming production, and analyze technical factors associated with the supply of materials used in production or in trade that affect the evolution of agricultural production;
- To coordinate activities between public and private actors and farmers to improve service necessary for production, including technical consultations, credits, supply of production and commercial factors;
- To prepare draft laws and regulations on the quality of agricultural products, use of production factors, maintenance, and vegetation hygiene protection and prepare regulatory texts related to farming production and follow up their implementation;
- To disseminate technology and agro-economic information to farmers and to industrial and commercial partners by cooperation with specialized public institution and farmer organizations;
- To monitor health status of plants in order to determine preventive measures and to arrange activities against disastrous events;
- To inspect the quality of equipment used in agricultural production and formulate methods of use;
- To monitor geological hygiene along the border and farm product processing entities;
- To determine policies and regulatory acts for land maintenance and use of agricultural land and land improvement to be cultivated, safe and soil filtration;
- To design policies for unused or under-used lands and standards for plantations and follow up their implementation; and
- To perform other duties assigned by the leadership.
Article 14:
The Department of Agro-Industry shall have the following roles:
- To design policies, plans, programs, projects and measures for development of agro-industry plants;
- To participate in resolving problems associated with the development of agro-industrial and food enterprises and formulate agro-industry policies that direct investments for processing and commercial production;
- To participate in making concepts and encourage and promote the agro-industry enterprises and agro-food enterprises;
- To participate in the encouragement and promotion of investments and exports of agricultural products and food;
- To disseminate technological and agro-economic information to farmers and to industrial and commercial partners in cooperation with specialized public institution and farmer organizations; and
- To perform other duties assigned by the leadership.
Article 15:
The Department of Production and Veterinary shall have the following roles:
- To design policies, plans, programs, projects and measures for development of production and veterinary;
- To follow up production and veterinary activities, analyze technical factors associated with the supply of materials used in production or in trade that affect the evolution of production and veterinary;
- To coordinate activities between public and private actors and animal farmers to improve services necessary for production, including technical consultations, credits, supply of production and commercial factors;
- To prepare draft laws and regulations on the quality of animal products, maintenance and veterinary protection and prepare regulatory texts related to production and veterinary and follow up their implementation;
- To disseminate technological and agro-economic information to animal farmers and to industrial and commercial partners in cooperation with specialized public institutions and farmer organizations; and
- To monitor the health status of animals in order to determine preventive measures and to arrange activities against disastrous incidents;
- To inspect the quality of equipment used in production and veterinary and formulate methods of use;
- To inspect the export and import of animals at borders and inspect animal hygiene and products made from animals, and monitor and follow up animal slaughters and at places where animal products were processed; and
- To perform other duties assigned by the leadership.
Article 16:
The Department of Agricultural Publication shall have the following roles:
- To organize, encourage and coordinate agricultural publication, research, and development activities by liaison with the provincial and municipal agricultural, forestry, and fisheries offices, research centers, producers, farmers, and professional organizations;
- To regularly monitor the activities and agricultural media based on information and topics given by farmers and specialized entities and evaluate the results of publications and propose method for improvement of media;
- To regularly record the knowledge obtained from farmers and results of technical research inside and outside of the Kingdom and disseminate such knowledge to the farmers;
- To collect and brainstorm knowledge of farmers and new findings resulting from research inside and outside of the Kingdom and disseminate and train farmers about such findings;
- To establish and maintain direct relationships between agronomy researchers or other experts and farmers, animal farmers, provincial and municipal agriculture, forestry and fisheries offices to increase a mutual exchange of information and technical knowledge that realize mutual compatibility; and the research and production shall reflect to the needs of agricultural development; and
- To perform other duties assigned by the leadership.
Article 17:
The Department of Agricultural Machinery shall have the following roles:
- To research and determine the zone where agricultural machinery, equipment, and machines shall be used based on category of land and farming plants for agricultural development;
- To prepare policies and regulatory acts on potential and efficiency of machinery in growing production;
- To research and initiate the production of agricultural equipment to reduce human labor in agricultural production activities;
- To instruct and disseminate techniques to machinery users to improve their production and productivity; and
- To perform other duties assigned by the leadership.
Article 18:
The Department of Forestry shall have the following roles:
- To prepare an inventory of forest resources and wildlife, evaluate potential, allocation of categories and follow up the evolution of forest and wildlife;
- To prepare projects, legal texts, regulatory acts and directives for protection and governing the forest resource exploitation, wildlife preservation and hunting, and monitor their implementation;
- To participate in the determination of environmental protection measures and design plans governing forest land, forest reserved for wildlife shelter, natural protection zones, reforestation zones, and forest and wildlife development policies;
- To study and research forestry and wildlife science and documentation;
- To inspect and manage all businesses associated with forestry products, sub-products, and wildlife hunting activities;
- To assist and encourage initiators who wish to protect and realize forestry and wildlife resources and concentrate on forest communities;
- To manage and develop zoos; and
- To perform other duties assigned by the leadership.
Article 19:
The Department of Fisheries shall have the following roles:
- To prepare an inventory of aquatic resources and evaluate potential, allocation of categories and follow up the evolution of aquatic resources and hydro-farming;
- To prepare projects, legal texts, regulatory acts, directives for protection, preservation, improvement and strengthening order of fishery zones and for governing aquatic resources both maritime and non-maritime, and monitor their implementation;
- To participate in the determination of environmental protection measures and design plans governing fishery zones and reserved fishery zones and determine policies for development and preservation of aquatic resources;
- To study and research aquatic science, hydro-farming and documentation;
- To inspect and manage all businesses associated with aquatic resources and fish culture;
- To assist and encourage initiators who wish to protect and realize aquatic resources and concentrate on fish culture; and
- To perform other duties assigned by the leadership.
Article 20:
The Department of Rubber Plantations shall function as a mechanism of the ministry for the following activities:
- To study and define policies for development of red lands and other lands that are fertile for rubber plantations and follow up the development of Cambodia rubber;
- To organize system of files and statistics on rubber;
- To study and disseminate rubber prices and needs for natural rubber on the national and international markets to promote and encourage family-sized rubber farmers;
- To conduct international cooperation for the promotion and development of red lands and other lands that are fertile for rubber plantations; and
- To perform other duties assigned by the leadership.
The General Department of Rubber Plantations shall be headed by one General Director and assisted by a deputy general director, if necessary.
This Department consists of two subordinate departments as stated in Article 2 below. Each department shall be headed by one director and assisted by a number of deputy directors, if necessary.
Article 21:
The Department of Rubber Development on shall have the following roles:
- To develop research and development plans on natural characteristics of red land and other lands that are fertile for rubber plantations;
- To study and disseminate laws to encourage investors to deal with rubber development;
- To cooperate with institutes of rubber research, rubber plantations and, international agencies for the promotion and development of rubber; and
- To perform other duties assigned by the leadership.
Article 22:
The Department of Marketing and Cooperation shall have the following roles:
- To disseminate information about rubber technology and economy to investors, family-sized rubber farmers, industrial or trade partners by cooperation with public specialized institutions and rubber farmer associations;
- To study and disseminate the need for and price of rubber on national and international markets;
- To follow up project implementation and evaluate rubber outputs and rubber production sectors; and
- To perform other duties assigned by the leadership.
Article 23:
There shall be an agriculture, forestry and fisheries office at each province and municipality who shall implement and coordinate ministerial activities.
Article 24:
The entities provided under Sub-paragraph (c) of Article 4 have been organized as public establishments of administrative status or public enterprises subject to technical jurisdiction of the Ministry of Agriculture, Forestry and Fisheries. The organization and functioning of public establishments or public enterprises shall be defined by Anukret and under its articles of association in compliance with the Kram CS/RKM/0696 of June 17, 1996 on the General Statute of Public Enterprises, and the Kret NS/RKT/1297/91 of December 31, 1997 on the Co-Statutes of public administrative establishments.
Article 25:
The Financial Auditing Entity was created by the Minister of Economy and Finance under the regulatory conditions defined by Anukret No. 81, dated November 16, 1995 on the establishment of financial auditing entities to audit ministerial budget expenditures.
Article 26:
The organization and functioning of the ministry at the central level beginning at the department level or lower shall be determined by Prakas of the Minister of Agriculture, Forestry and Fisheries.
Article 27:
For the duties relevant to the authority of other institutions the chief of such institution and the Minister of Agriculture, Forestry and Fisheries shall cooperate to allocate the responsibilities and perform such activities through a joint Prakas of the Minister of Agriculture, Forestry and Fisheries and the chief of such institution.
Article 28:
Any provisions, which are contrary to this Anukret, shall be null and void.
Article 29:
The Minister in charge of the Council of Ministers, the Minister of Agriculture, Forestry and Fisheries, and the Ministers and Secretaries of State of all relevant institutions shall effectively implement this Anukret from the date of signature.
Article 30:
This Anukret shall enter into force from the date of signature.
