The Restructuring of Function and Roles and the
Creation of Jurists Group and Department of ASEAN and International Cooperation
of the Ministry of Tourism

Having seen the Constitution
of the Kingdom of Cambodia,
-
Having seen Kret
NS/RKT/1198/72, dated November 30, 1998 regarding the Establishment of the
Royal Government of Cambodia,
-
Having seen Kram 02/NS/94,
dated July 20, 1994, promulgating the Law on the Organization and Functioning
of the Council of Ministers,
-
Having seen Kram
NS/RKM/0196/15, dated January 24, 1996 on the Creation of the Ministry of
Tourism,
- Having seen Anukret 34/ANK/BK, dated August 5, 1997 regarding the Organization and Functioning of Ministry of Tourism,
-
Pursuant to the request
of Minister of Tourism,
Article 1:
To
amend Sub-paragraph 11 of Article 3 of Anukret 34/ANKr/BK of August 5, 1997 on
the Organization and Functioning of the Ministry of Tourism, the Ministry of
Tourism shall have the following functions and roles in issuance of tourism
licenses to:
-
Tourism
companies, tourism agencies, tourist transport operators, tourist guides,
hotels, guest houses, tourist sites and sports tourism sites; and
-
Restaurants,
bars, karaoke establishments, discotheques, clubs, massage and other businesses
and services which are devoted to providing services for tourists.
Article 2:
To
create a group of jurists in the Ministry of Tourism with the following
functions and roles:
-
To
conduct research and cooperate with relevant institutions to prepare draft
laws, royal decrees, Anukret, Prakas, Circulars, and regulations related to
tourism; and
-
To
study/research and review draft contracts related to tourism in the Kingdom of
Cambodia.
Article 3:
A
group of jurists shall be headed by one group leader and composed of a number
of members who are serving in the existing cadre.
Article 4:
A
leader of the group of jurists shall enjoy the status and immunity equivalent
to chief of department. The leader of
the group of jurists shall have the role in leadership and organization for the
implementation of the functions and roles as stated in Article 2 of this
Anukret.
Article 5:
To
transform the International Cooperation Office under the Department of
Development Plan of the General Department of Tourism into Department of
International Cooperation of the General Department of Tourism with the
following functions and roles:

To
study and design tourism development policies and strategies which fall into
the scope of works relevant to ASEAN;
-
To
implement international cooperation activities;
-
To
conduct tourism cooperation with the organizations, associations, and
international institutions which fall into international and ASEAN's scope of
works;
-
To
compile, draft and prepare signing ceremonies for agreements, memoranda,
minutes between the Ministry of Tourism of the Kingdom of Cambodia and regional
tourism institutions and countries in the world;

To
establish relationships with embassies and ministries for international
affairs; and
-
To
cooperate in the organization of meetings, seminars, and other ceremonies for
ministerial leadership.
Article 6:
The
Department of ASEAN and International Cooperation shall be headed by one
director and assisted by a number of assistants if necessary.
Article 7:
Prakas
of the Minister of Tourism shall determine the organization of functions, roles
and the functioning of each office subject to the group of jurists and
Department of ASEAN and International Cooperation.
Article 8:
Any
provision that is contrary to this Anukret shall be null and void.
Article 9:
The
Minister in charge of the Council of Ministers, the Minister of Tourism,
Minister of Economy and Finance, Secretary of State for Public Function, the
Co-Ministers, all Ministers and Secretaries of State of relevant institutions
shall effectively implement this Anukret from the date of signature herein.
