Promotion for Military Officer and Career Deputy Officer

Seen the constitution of the Kingdom of Cambodia

Seen the Kret NS/RKT/1198-72 dated 30 November, 1998 regarding the appointment of the Royal Government of Cambodia

Seen the Kram 02 NS/94 dated 20 July, 1994, promulgating the Law on the Organization and Functioning of the Council of Ministers

Seen the Kram NS/RKM/0196-07 dated 24 January, 1997 promulgating the Law on the establishment of the Ministry of Defense

Seen the Kram CS/RKM/1197-05 dated 06 November, 1997 promulgating the General Military Statute of the Royal Cambodian Armed Force.

HEREBY DECLARE
Article 1

The promotion for the military officer rank and career deputy officer below this rank of the three armed forces shall comply with chapter 4, articles 30, 31, 32, and 36 of the General Military Statute of the Royal Armed Force and shall function under normal and special conditions.

A) For the Military Officer:

The normal condition shall be based on the seniority, options in proportion to qualifications, and service period.
The special condition shall be based on a warring period as for those who have combat accomplishments, those who got killed at the battlefield or during the peace, those who voluntarily resign from the Army or request for retirement pursuant to the Ministry of Defense policy.

B) For the Deputy Officer:

The normal condition shall be based on the seniority, options in proportion to unit, and category and number of the required army among the career military officers who have sufficient seniority, degree or certificate of military education, and annual scores of the interested military.
The special condition shall be based on those who got killed at the battlefield or during the peace period, who voluntarily resigns from the Army or requests for retirement pursuant to the Ministry of Defense policy.

The promotion of the military officer and career deputy officer under the normal conditions shall be made after it was reviewed by the ranking committee.

Article 2

The composition of the promotion committee of the three armed forces shall include:

The Minister of Defense	Chairman
The Commander-in-chief of the Royal Armed Force	vice- chairman
One commander representing infantry force, marine force, air force, police militia, and expert armed force	Member
The director of Personnel Department of the Ministry of Defense	Reporter
The director of Personnel Office of RAF's Chief of General Staff	Secretary

Article 3

The promotion committee is obligated to call for an annual meeting of its members on the specified date.

The department of personnel is obligated to instruct, manage, and collect files requesting for the promotion of military officer, and career deputy officer of the three armed forces from various military units and institutions under the Royal Armed Force, including:

1/ The promotion application of military officer and career deputy officer by a unit and each category of armed force.

2/ The table of seniority records of the military officer and career deputy officer as of the year of promotion which is annually prepared by each unit, based on type of weapon, skills, and type of each armed force.

These files shall be sent to the department of personnel in early of September of each year for conclusion and report to the promotion committee for review and approval.

Article 4

The cabinet of the Ministry of Defense, cabinet of the Chief ofGeneral Staff, all units under the Royal Armed Force shall be accountable for the enforcement of this Prakas form the date of signature herein.
