ON THE ROLES AND RESPONSIBILITIES OF THE ROYAL GOVERNMENT’S INSPECTOR AND THE ASSISTANT INSPECTOR

The Royal Government of Cambodia
- Having seen the Constitution of the Kingdom of Cambodia;
- Having seen the Kret of His Majesty the King of Cambodia Samdech Preah NORODOM SIHANOUK VARMAN dated November 1, 1993 on the Appointment of the Royal Government of Cambodia;
- Having seen the Kret No. 1094-83 dated October 24, 1994 on the Reorganization of the Composition of the Royal Government of Cambodia;
- Having seen the Kret No. 1094-90 dated October 31, 1994 on the Reorganization of the Composition of the Royal Government of Cambodia;
- Having seen the Law on the Organisation and Functioning of the Council of Ministers promulgated by the Kram No. 02/94 dated July 20, 1994;
- Having seen the Anukret No.62 dated July 31, 1995 in the Supervision of weapons and ammunition;
- Having seen the Anukret No. 30 dated July 1, 1994 in the Roles and Responsibilities of the Senior Minister in charge of Inspection;
- Having seen the Anukret No. 75 dated October 5, 1995 on the elimination and establishment of border and road check-points throughout the country;
Pursuant to the need to implement the laws;
Decides:
Article 1:
The Royal Government’s Inspection Unit shall be a distinct unit reporting to the Senior Minister in charge of Inspection. It shall have the responsibility for inspecting all legal checkpoints and eradicating the checkpoints throughout the Kingdom of Cambodia in order to impose discipline on officials working there and to assure the proper implementation of their tasks.
Article 2:
The roles and responsibilities of the Inspection Unit shall be the followings:
- To inspect each check point in accordance with the Sub-Decree No.75 dated October 05, 1995
- To instruct officials on the implementation of the various laws as related to their relevant institutions
- To direct the process of eradicating the check points throughout the country.
Article 3:
The Inspection Unit of the Royal Government shall have the following duties:
- To submit proposals to the Senior Minister in charge of Inspection to appoint an inspection unit or an envoy to inspect a checkpoint, and request collaboration from provincial and municipality authorities.
- During inspections, the Inspection Unit or an envoy shall have the right to request information and documents from concerned officials and staff members.
- After any inspection, the Inspection Unit shall have the duty to submit a report to the Senior Ministers in charge of Inspection for the Royal Government approval.
- In the event an armed group or persons set up checkpoints or resists the inspection, the Inspection Unit shall prepare the necessary documents and forward them to the court.
- The Inspection Unit shall have the duty to suggest to the concerned ministry or provincial and municipality authorities for the removal of any member of the armed forces or officials responsible for operating these illegal checkpoints at the expenses of the reputation of the national police, the social security, and the wellbeing of people.
Article 4:
The Inspection Unit shall have the following composition:
- A representative of the Senior Minister in charge of Inspection Chairman
- A representative of the Office of the Council of Ministers. Member
- A representative of the Ministry of Defense. Member
- A representative of the Ministry of Interior. Member
- A representative of the Ministry of Economy and Finance. Member
- A representative of the Ministry of Commerce. Member
- A representative of the Ministry of Agriculture. Member
- A representative of the Ministry of Health. Member
- A representative of the Ministry of Public Works and Transports. Member
- A representative the Civil Aviation Authority. Member
- An official of the Royal Government’s Inspection Unit. Secretary
Article 5:
The Royal Government’s Inspection Unit shall be composed of 3 group of inspectors to assist in its work:
A. The roads and airports inspection group shall have the following composition:
- An official under the direct supervision of the Senior Minister Chairman
- A representative of the Office of the Council of Ministers. Member
- A representative of the Ministry of Defense. Member
- A representative of the Ministry of Interior. Member
- A representative of the Ministry of Economy and Finance. Member
- A representative of the Ministry of Commerce. Member
- A representative of the Ministry of Agriculture. Member
- A representative of the Ministry of Health. Member
- A representative the Civil Aviation Authority. Member
- An official of the Royal Government’s Inspection Unit. Secretary
B. The waterways inspection group shall have the following composition:
- An official under the direct supervision of the Senior Minister Chairman
- A representative of the Office of the Council of Ministers. Member
- A representative of the Ministry of Defense. Member
- A representative of the Ministry of Interior. Member
- A representative of the Ministry of Economy and Finance. Member
- A representative of the Ministry of Commerce. Member
- A representative of the Ministry of Agriculture. Member
- A representative of the Ministry of Health. Member
- A representative of the Ministry of Public Works and Transports. Member
- An official of the Royal Government’s Inspection Unit. Secretary
C. The seaways inspection group shall have the following composition:
- An official under the direct supervision of the Senior Minister Chairman
- A representative of the Office of the Council of Ministers. Member
- A representative of the Ministry of Defense. Member
- A representative of the Ministry of Interior. Member
- A representative of the Ministry of Economy and Finance. Member
- A representative of the Ministry of Commerce. Member
- A representative of the Ministry of Agriculture. Member
- A representative of the Ministry of Health. Member
- A representative of the Ministry of Public Works and Transports. Member
- An official of the Royal Government’s Inspection Unit. Secretary
Article 6:
The official representative of each ministry shall be appointed to serve in the Royal Government’s Inspection Unit and in the support group with the approval of the concerned ministry and upon the proposal of the Senior Minister in charge of Inspection.
Article 7:
The ways and means and operating budget for the Royal Government’s Inspection Unit shall be submitted to the Office of the Council of Ministers to be include in the annual budget.
Article 8:
The Co-Ministers in charge of the Office of the Council of Ministers, the Co-Ministers of Defense, the Co-Ministers of Interior, the Minister of Economy and Finances, the Minister of Commerce, the Minister of Agriculture, the Minister of Health, the Minister of Public Works and Transports and ministers or Secretaries of State of concerned institutions shall co-operate in implementing this declaration.
Article 9:
This declaration shall enter into force from the date of its signature.
