ANUKRET

on

the Issuance and Use of Diplomatic and Official Passports

 

The Royal Government

 

-          Having seen the Constitution of the Kingdom of Cambodia;

-          Having seen Reach Kret NS/RKT/1198/72 of November 30, 1998 regarding the Establishment of the Royal Government of Cambodia;

-          Having seen Reach Kram 02/NS/94 of July 20, 1994, promulgating the Law on the organization and functioning of the Council of Ministers;

-          Having seen Reach Kram  NS/RKM/0196/10 of January 24, 1996, promulgating the Law on the Creation of the Ministry of Foreign Affairs and International Cooperation;

-          Having seen Reach Kram  05/NS/94 of September 22, 1994, promulgating the Law on Immigration;

-          Having seen Anukret  68/ANK of October 25, 1994 on the Passport of the Kingdom of Cambodia;

-          Pursuant to the need for preparation of reciprocal visas for diplomatic and official passports with member states of the Association of South-East Asian Nations;

-          Pursuant to the approval of the Council of Ministers at its plenary session of August 11, 2000;

 

HEREBY DECIDES

 

CHAPTER 1
General Provisions

 

Article 1:

The purpose of this Anukret is to determine the issuance and use of diplomatic and official passports by dignitaries and civil servants of the Kingdom of Cambodia who shall use them only during an official mission in a foreign country, except for the King, Queen or King’s spouse. A dignitary or civil servant who travels to a foreign country on private business shall use a normal passport.

 

CHAPTER 2

Diplomatic Passport

 

Article 2:

A diplomatic passport shall be issued to a senior Cambodian dignitary based on the order of rank and position listed below and his/her spouse and single children who are under his/her support and are  below 18 years of age.

 

1)      The King, Queen or King’s spouse;

2)      The King’s sons and daughters and relatives who have been certified by the Ministry of Royal Palace at the order of the King, Queen or King’s spouse;

 

3)      The president and vice president of the Senate, president and vice president of the National Assembly, president and members of the Constitutional Council, senior advisor of the King, prime minister, deputy prime ministers, senior ministers and ministers, governor of the National Bank of Cambodia, president of the Supreme Court, prosecutor general attached to the Supreme Court, secretary general of the Royal Government, commander-in-chief of the Royal Armed Force, and the director general of the National Police;

 

4)    A dignitary who enjoys a rank as Samdech;

 

5)      The former president and vice president of the Senate, former president and vice president of the National Assembly, former prime minister, former minister of foreign affairs after entry into force of this Anukret; and

 

6)    A diplomat who enjoys an attaché or superior rank who is serving diplomatic services in a foreign state.

 

Article 3:

A diplomatic passport shall be issued to a senior Cambodian dignitary based on the order of rank and position listed below. The spouse and children who are under his/her support may not be entitled to diplomatic passport.

 

1)      The members of the Senate, members of the National Assembly, president and vice president of the National Election Committee;

 

2)      The secretaries and under-secretaries of State of ministries and institutions;

 

3)      The vice secretary general of the Royal Government, vice governor of the National Bank;

 

4)      Vice president of the Supreme Court, vice prosecutor general attached to the Supreme Court, president of the Appellate Court, prosecutor general attached to the Appellate Court;

 

5)      Officials in public services who serve as director general, general inspector or higher rank, listed in the organizational chart of the ministry/institution, and appointed through a royal decree.

 

6)      Military officials who serve as director general of the Ministry of National Defense or in higher rank, deputy commander-in-chief, director of joint headquarters, commander of the infantry, commander of the air force, and commander of the navy of the Royal Armed Forces, commander of national military police, and police official who serve as deputy director general of the National Police;

 

7)      Advisor who serves a rank equivalent or superior to under-secretary of State;

 

8)      Former deputy prime minister;

 

9)      Delegates of the Royal Government who serve as governor or vice governor of Phnom Penh, and provincial/municipal governors; and

 

10)      Protocol presidents of the King, Prime Minister, Senate, National Assembly, Ministry of Foreign Affairs.

 

Article 4:

Diplomatic passport shall also be issued to the patriarchs of both sects and monks who enjoy a rank as Samdech.

 

Article 5:

Diplomatic passport shall be valid for three years and may be renewed every two years so long as the holder remains in the same rank and position as stated in Articles 2, 3 and 4 of this Anukret.

 

An official whose rank and position has expired, a retired official, convicted official, or an official whose cadre was suspended and an official who was absent and no salary has been paid for six (6) months or more shall not be entitled to use diplomatic passport.

 

CHAPTER 3

Official Passport

 

Article 6:

An official passport shall be issued to the civil servant, military, police, and senior monk only for use during an official mission in a foreign country.

 

Article 7:

An official passport shall be valid for a period that is similar to the duration of official mission in a foreign country.

 

CHAPTER 4

Authority to Issue and Revoke Passport

 

Article 8:

The Ministry of Foreign Affairs and International Cooperation has the duty to issue diplomatic and official passports in accordance with the provisions of Articles of this Anukret.

 

Any diplomatic and official passports that fail to meet the requirement of Articles 2, 3, 4, 5 and 6 above shall no longer be valid from the 1st of January 2001.

 

The Ministry of Foreign Affairs and International Cooperation has the duty to revoke or refute any passport documents which have expired, disappeared or  have been  falsified.

 

CHAPTER 5

Final Provisions

 

Article 9:

Chapter 2 related to  “diplomatic passport” and Chapter 3 on “official passport” of Anukret No. 68/ANK/BK of October 25, 1994 on the Kingdom of Cambodia’s passport and any provisions that are contrary to this Anukret shall be deemed abrogated.

 

Article 10:

The Minister in charge of the Council of Ministers, the Minister of Foreign Affairs and International Cooperation, the relevant Ministers and Secretaries of Sate shall effectively implement this Anukret from the date of signature.
