ANUKRET on

The Organization and Functioning of the General

Secretariat of the Council for Administrative Reform 

 

The Royal Government

 

-          Having seen the Constitution of the Kingdom of Cambodia;

-          Having seen Reach Kram No. 02/NS/94 of July 20, 1994, promulgating the Law on the organization and functioning of the Council of Ministers;

-          Having seen Reach Kret No. NS/RKT/1198/72 of November 30, 1998 regarding the Establishment of the Royal Government of Cambodia;

-          Having seen Reach Kret No. NS/RKT/0399/72 of May 19, 1999 on the Creation of the Supreme Council for State Reform;

-          Having seen Anukret No. 51/ANK/BK of June 10, 1999 on the Creation of the Council for Administrative Reform;

-          Having seen Anukret No. 52/ANK/BK of June 10, 1999 on the Organization and Functioning of the Council for Administrative Reform;

-          Pursuant to the proposal made by the Council for Administrative Reform.

 

DECIDES

 

CHAPTER 1

General Provisions

 

Article 1:

This Anukret defines the mission, role, duty and organization of entities of the General Secretariat of the Council for Administrative Reform.

 

 

Chapter 2

Mission and Structure

 

Article 2:

The Council for Administrative Reform shall have one general secretariat as an executive body under the leadership and management of one secretary general and a number vice secretaries as needed.

 

 

Article 3:

The Council for Administrative Reform’s general secretariat mission is to enforce administrative reform programs as instructed and directed by the Council for Administrative Reform’s chairman. Among these missions, the tasks of the general secretariat are to study and propose to the Royal Government through the Council for Administrative Reform short-term, medium and long-term administrative reform projects; to follow up and evaluate the performed administrative reform projects; and to regularly report to the Royal Government about the results of such project performances.

 

In addition, the secretary general shall perform conceptual and planning tasks and operate, coordinate, and evaluate all projects listed in the administrative reform program. The roles of the general secretariat are to monitor, follow up, and ensure a coherent performance of reform program carried out at ministries, institutions, authorities and public entities.

 

Article 4:

The Council for Administrative Reform’s general secretariat shall meet at least once every month as convened and instructed by the secretary general.

 

Article 5:

The Council for Administrative Reform’s general secretariat shall have the right use the seal of the Council of Ministers in performance of its activities.

 

Article 6:

The Secretary General submits a proposal to the Council for Administrative Reform for review and make a decision on the appointment, promotion, or removal of officials and staff of the general secretariat form their positions.

 

Article 7:

The Vice Secretary General shall serve as assistant of the Secretary General. The Chairman of the Council for Administrative Reform shall define allocation of responsibilities for the Vice Secretary General at the proposal of the Secretary General.

 

Article 8:

The General Secretariat shall have following structures:

 

I. Five units under the direct supervision of the General Secretariat:

 

(1)            General administrative unit;

(2)            Logistic support unit;

(3)            Information technology unit;

(4)            Governance unit; and

(5)            Information unit.

 

II. Four project units for development and improvement of public services:

 

(1)                 Function analysis unit;

(2)                 De-concentration, decentralization and public service unit;

(3)                 Legal affairs unit; and

(4)                 Training unit.

 

One chairman who has a position equivalent to or superior to deputy to general director shall manage each of these units.

 

III. Three Project Units in Charge of Changes:

 

(1)Prioritization unit;

(2)Cadre policy and inspection unit; and

(3)     Benefits system unit.

 

One chairman who has a position equivalent to or superior to deputy to general director shall manage each of these units.

 

VI. Three Project Units for Management and Rationalization of Civil Servants:

 

(1)Civil servant census unit;

(2)Civil servant rationalization unit; and

(3)Payroll scale unit.

 

One chairman who has a position equivalent to or superior to deputy to general director shall manage each of these units.

 

Article 9:

The Secretary General shall submit a proposal to the Council for Administrative Reform for review and approve on the changes or creation of new projects as needed.

 

Article 10:

The organization and functioning of the project units and each entity of the general secretariat shall be determined by a decision of the Council for Administrative Reform’s Chairman.

 

Article 11:

Each project unit shall have following roles and responsibilities:

 

-                 To realize inter-technical system and relationship between general secretary of the Council for Administrative Reform and the ministries/institutions;

 

-                 To provide consultations and act as technical assistant various ministries/institutions;

 

-                 To act as partner in discussion with representatives from various ministries/ institutions regarding the projects of administrative reform program; and

 

-                 To responsible before the Council for Administrative Reform’s general secretariat in implementing and monitoring the project performances at various ministries/ institutions.

 

Article 12:

The roles and responsibilities of the general administrative unit are to:

 

-                 Serve as secretariat of and mechanism of the general secretariat in administrative coordination of project unit activities and all entities under the general secretariat;

-                 Maintain and circulate prepare administrative and financial files;

-                 Ensure efficiency and administrative safety of the general secretariat;

-                 Put together and prepare activity report of the general secretariat; and

-                 Administer officials and staff of the general secretariat.

 

Article 13:

The roles and responsibilities of the logistic unit are to:

 

-                 Provide logistic and material support for the general secretariat;

-                 Develop and implement annual budget plan of the general secretariat;

-                 Monitor and reinforce implementation of budget and maintain accounts of the general secretariat;

-                 Manage immovable and movable property, material stock, and inventory lists;

-                 Make expense program to meet the need and prepare quarterly report;

-                 Coordinate and follow up financing status of each ministerial sector to ensure strengthening of resources and to achieve economic standard system; and

-                 Ensure record, documentation, and translation services.

 

Article 14:

The roles and responsibilities of the information unit are to:

 

-                 Coordinate relationship with various ministries, institutions, councils, authorities, and public entities;

-                 Maintain good relationship with the general public, local and foreign non-governmental organizations, international organizations, representatives of donor countries;

-                 To collect and keep information and documents related to the administrative reform program; and

-                 Prepare texts and publication of bulletin and advocacy bulletin of administrative reform program.

 

Article 15:

The roles and responsibilities of the information technology unit are to:

 

-                      Provide information technology service to project units and units of the general secretariat;

-                      Build database;

-                      Train computer staff for skill proficiency;

-                      Enter data into information technology system; and

-                      Ensure efficiency of the information technology operation.

 

Article 16:

The roles and responsibilities of the governance unit are to:

 

-                 Provide consultation and technical assistance regarding governance to the ministry or institution;

-                 Prepare draft of governance action plan of the Royal Government;

-                 Maintain coordination and close relationship with the ministries, councils, and other main good governance counterparts; and

-                 Responsible before the general secretariat in promoting the monitoring and evaluation project implementation to strengthen good governance within the ministries, institutions, and public entities.

 

Article 17:

Each unit shall be supervised and managed by one director and a number of deputy directors if it is necessary.  The director shall enjoy status at least equivalent to deputy director of department. The deputy director shall enjoy status at least equivalent to office director.

 

Article 18:

The general secretariat of the Council for Administrative Reform shall have the rights to use officials in public service and recruit contracting staff if necessary.

 

Staff of the general secretariat of the Council for Administrative Reform may receive remuneration donated by donor countries or international organizations.

 

CHAPTER 3

Final Provisions

Article 19:

Anukret No. 42/ANK/BK of June 10, 1999 on the organization and functioning of the Council for Administrative Reform shall be deemed abrogated.

 

Article 20:

The Deputy Prime Minister, the Senior Minister in charge of the Council of Ministers, all relevant Ministers and Secretaries of State and all members of the Council for Administrative Reform shall effectively implement this Anukre from the date of signature.
