ANUKRET on

 

The Creation of a Council for Development of Social Affairs

 

The Royal Government

 

-          Having seen the Constitution of the Kingdom of Cambodia;

-          Having seen Reach Kram 02/NS/94 of July 20, 1994, promulgating the Law on the organization and functioning of the Council of Ministers;

-          Having seen Reach Kret NS/RKT/1198/72 of November 30, 1998 regarding the Establishment of the Royal Government of Cambodia;

-          Having seen Reach Kram NS/RKM/0399/72 of March 19, 1999 on the Creation of Supreme Council for State Reform;

-          Having seen Reach Kret NS/1100/213 of November 29, 2000 on the Restructuring of membership of the Supreme Council for State Reform;

-          Pursuant to the proposal of Supreme Council for State Reform;

 

DECIDES

 

CHAPTER 1: General Provision

 

Article 1:

A Council for Development of Social Affairs shall be created to assist in an operation of the Supreme Council for State Reform regarding social affairs. The Council for Development of Social Affairs shall be located at the Ministry of Planning’s cabinet.

 

CHAPTER 2: Mission and Membership

 

Article 2:

The Council for Development of Social Affairs mission shall be to initiate, promote, operate, facilitate and monitor the implementation of social affairs policies and programs as directed by the Supreme Council for State Reform.

 

Article 3:

The roles and duties of the Council for Development of Social Affairs are to:

 

(1)     Initiate and propose to the Supreme Council for State Reform strategies, action plans, programs in order to reduce poverty by focusing on education, healthcare, social affairs, agriculture and rural development objectives;

(2)     Implement instructions issued by the Supreme Council for State Reform in enforcing strategies and work programs for social affairs;

(3)     Make decisions and instruct all ministries and institutions to implement work programs for social affairs which fall under their jurisdictions;

(4)     Promote and coordinate activities of the ministries and institutions regarding social affairs programs;

(5)     Monitor social affairs programs implemented by ministries or institutions and report achievements to the Supreme Council for State Reform;

(6)     Propose draft laws, regulations and measures regarding social affairs to the Supreme Council for State Reform;

(7)     Establish relationships and coordination in lobbying public resources and international assistance to cover the implementation of social affairs programs;

(8)     Within its scope of jurisdiction, provide ministries or institutions with technical support related to the development of social affairs that are necessary to such entities;

(9)     Promote and supervise dissemination of information about the objectives, competencies and achievement in the development of Social Affairs; and

(10) Perform other roles and tasks assigned by the Supreme Council for State Reform.

 

Article 4:

A composition of the Council for Development of Social Affairs shall be as follows:

4. Secretary of State for Agriculture, Forestry and Fisheries

5. Secretary of State from the Ministry of Rural Development

7. Secretary of State for Education, Youth and Sports

-

8. Secretary of State for Women Affairs and Veteran

-

9. Secretary of State for Social Affairs, Labor, Vocational

Training, and Youth Rehabilitation

10.    Secretary of State for Land management, Zoning and Construction

-

11.    Undersecretary of State from the Council of Ministers

-

12.    Undersecretary of State from the Ministry of Planning

Secretary General

13.    Vice Secretary General of the Council for the Development

of Cambodia

Article 5:

The roles of the Council for Development of Social Affairs’ Chairman are as follows:

 

-          To take responsibility and perform activities of the Council for Development of Social Affairs as stated in the previous articles and exercise diligent efforts to ensure an efficient Development of Social Affairs activities;

-          To set up agenda for meetings of the Council for Development of Social Affairs; and

-          To preside at the meeting discussion and issue decisions.

 

Article 6:

The Chairman may invite a member of the Royal Government or dignitary who has qualification to participate in the meeting of the Council for Development of Social Affairs.

 

Article 7:

The Chairman is entitled to sign a bilateral or multilateral financial agreement and any contracts or regulatory texts related to Development of Social Affairs.

 

Article 8:

The Chairman has full rights over administrative and financial management of the Council for Development of Social Affairs.

 

Article 9:

The Chairman of the Council for Development of Social Affairs shall have the rights to propose, if necessary, the appointment of national and international experts and dignitary or senior government officials who have legal, administrative, social affairs, governance expertise as technical advisors to study, prepare concepts or social affairs plans and make proposals to the Council for Development of Social Affairs for a short term, medium, or long term Development of Social Affairs Plan.

 

Article 10:

In performing its activities, the Council for Development of Social Affairs shall have the right to use the seal of the Ministry of Planning.

 

CHAPTER 3: General Secretariat

 

Article 11:

The Council for Development of Social Affairs has as its general secretariat an executive body under the leadership and management of one secretary general.

 

Article 12:

The secretary general shall be assisted by a vice secretary general and advisor. The vice secretary general and members shall be appointed through Anukret at the proposal of the secretary general with the approval of the Council for Development of Social Affairs.

 

Article 13:

The organization and functioning of the general secretariat of the Council for Development of Social Affairs shall be determined by a separate Anukret.

 

CHAPTER 4: Funding Source

 

Article 14:

The Council for Development of Social Affairs shall have its separate budget, which is a supplemental budget of the Ministry of Planning.

 

Article 15:

The national budget and foreign funding by organizations and international banks shall support resources and the budget of the Council for Development of Social Affairs.

 

CHAPTER 5: Final Provisions

 

Article 16:

Anukret No.15/ANKr-BK of April 04, 2000 on the Creation of Monitoring Committee for Allocation of Social Affairs Assistance and any provisions that are contrary to this Anukret shall be deemed abrogated.

 

Article 17:

The Deputy Prime Minister, the Senior Minister in charge of the Council of Ministers, the Senior Ministers, the Minister of Planning, and Ministers and Secretaries of Sate and all members of Council for Development of Social Affairs shall effectively implement this Anukret from the date of signature.
