ANUKRET on
The Creation of a Council for Land Management Policy

Constitution of the Kingdom of Cambodia;

functioning of the Council of Ministers;

NS/RKT/1198/72 of November 30, 1998 regarding the Establishment of the Royal
Government of Cambodia;

NS/RKM/0399/72 of March 19, 1999 on the Creation of Supreme Council for State
Reform;

Having seen Reach Kret
NS/1100/213 of November 29, 2000 on the Restructuring of membership of the
Supreme Council for State Reform;

Pursuant to the proposal of
Supreme Council for State Reform;
Article 1:
A Council for Land Management Policy shall be created to assist in an operation of the Supreme Council for State Reform regarding land management. The Council for Land Management Policy shall be located at the Ministry of Land Management, Zoning, and Construction.
CHAPTER 2:
Mission and Membership
Article 2:
The Council for Land Management Policy's mission shall be to initiate the functioning, and monitor the implementation of policies and land policy programs as directed by the Supreme Council for State Reform.
Article 3:
The roles and duties of the Council for Land Management Policy are to:
1. Initiate and propose to the Supreme Council for State Reform plans, work programs and strategic plans to achieve land organization, management, and distribution objectives;
2. Implement instructions issued by the Supreme Council for State Reform in enforcing strategies and work programs for land;
3. Make decisions and instruct the ministries, institutions, provincial or municipal authorities to enforce work programs for land which fall under its jurisdiction;
4. Coordinate activities of the ministries, institutions regarding work programs for land;
5. Propose land policies to the Supreme Council for State Reform for approval;
6. Propose draft laws, regulations and measures regarding land to the Supreme Council for State Reform;
7. Coordinate public resources and international assistance for use in land management;
8. Supervise and organize training, and dissemination about land management to interested institution and the general public; and
9. Regularly report to the Supreme Council for State Reform about achievements in land management.
Article 4:
A composition of the Council for Land Reform shall be as follows:

Article 5:
The roles of the Council for Land Management Policy’s Chairman are follows:
· To take responsibility for, and perform the activities of the Council for Land Management Policy as stated in the previous articles and exercise diligent efforts to ensure an efficient land management activities;
· To call meetings of the members, set up the agenda for meetings of the Council for Land Management Policy;
· To preside at the meetings and discussion and issue decisions;
· The Chairman may invite a member of the Royal Government or dignitary having expertise to participate in the meeting of the Council for Land Management Policy;
· The Chairman is entitled to sign a bilateral or multilateral financial agreements and any contracts or regulatory texts related to land management activities; and
· The Chairman has full rights over administrative and financial management of the Council for Land Management Policy.
Article 6:
The Chairman of the
Council for Land Management Policy shall have the right to propose, if
necessary, the appointment of national and international experts and
dignitaries or senior government officials with legal, administrative or
technical specialties as technical experts to study and prepare concepts or
land planning and make proposals to the Council for Land Management Policy for
a land management plan to be enforced.
CHAPTER 3: General Secretariat
Article 7:
The Council for Land Management Policy has as its general secretariat an executive body under the leadership and management of one secretary general.
The secretary general shall be assisted by a vice secretary general and advisor. The vice secretary general and an advisor shall be appointed through Anukret at the proposal of the secretary general with the approval of the Council for Land Management Policy.
Article 8:
The organization and functioning of the general secretariat of the Council for Land Management Policy shall be determined by a separate Anukret.
Article 9:
In performing its activities, the Council for Land Management Policy shall have the right to use the seal of the Ministry of Land Management, Zoning and Construction.
CHAPTER 4: Funding Source
Article 10:
The Council for Land Management Policy shall have its separate budget, which is a supplemental budget of the Ministry of Land Management, Zoning and Construction.
Article 11:
Resource and budget of the Council for Land Management Policy shall be supported by:
· Contributions of national budget;
· Funding obtained from donor country or international organizations.
CHAPTER 5: Final Provisions
Article 12:
Any provisions that are contrary to this Anukret shall be deemed abrogated.
Article 13:
The Deputy Prime Minister, the Senior Minister in charge of the Council of Ministers, the Senior Ministers, Ministers and Secretaries of Sate and all members of Council for Land Management Policy shall effectively implement this Anukret from the date of signature.
