ANUKRET on

 

The Restructuring and Responsibility of the Council for

 Agricultural and Rural Development “CARD”

 

 

The Royal Government

 

-          Having seen the Constitution of the Kingdom of Cambodia;

-          Having seen Reach Kret NS/RKT/1198/72 of November 30, 1998 regarding the Establishment of the Royal Government of Cambodia;

-          Having seen Reach Kram 02/NS/94 of July 20, 1994, promulgating the Law on the Organization and Functioning of the Council of Ministers;

-          Having seen Anukret 56/ANK/BK of July 11, 1995 on the Creation of Council for Agricultural and Rural Development;

-          Having seen Anukret 79/ANK/BK of December 29, 1998 on the Restructuring and Responsibilities of Council for Agricultural and Rural Development;

-          Pursuant to the current need;

 

DECIDES

 

CHAPTER 1:
 Structure and Composition of the Council for
Agricultural and Rural Development “CARD”

 

Article 1:

The structure and composition of the CARD were restructured as follows:

 

1.      The Prime Minister

Chairman

2.      One dignitary of Ministerial rank

Vice-chairman

3.      First Deputy Director of National Committee for Disaster Management

Member

4.      Minister or representative of the Council of Ministers         

Member

5.      Minister or representative of the Ministry of Interior

Member

6.      Minister or representative of the Ministry of Economy and Finance

Member

7.      Minister or representative of the Ministry of Rural Development

Member

8.      Minister or representative of the Ministry of Health

Member

9.      Minister or representative of the Ministry of Agriculture, Forestry and Fisheries

Member

10.   Minister or representative of the Ministry of Water Resource and Meteorology

Member

11.   Minister or representative of the Ministry of Environment

Member

12.   Minister or representative of the Ministry of Commerce

Member

13.   Minister or representative of the Ministry of Planning

Member

14.   Minister or representative of the Ministry of Public Work and Transport

Member

15.   Minister or representative of the Ministry of Land Management, Urban Planning, and Construction

Member

16.   Minister or representative of the Ministry of Women’s and Veterans’ Affairs

Article 2:

To create a general secretariat of CARD under the direct supervision of one secretary general and a number of deputy secretaries if necessary.

 

The CARD’s general secretariat consists of 6 specialized units with specialized personnel:

 

-          Administrative and Financial Unit;

-          Agricultural Unit includes animal raising, equipment, machinery, and human resource etc.;

-          Rubber Plantation Unit;

-          Rural Development Unit;

-          Forest exploitation and Fishery product Unit; and

-          Water Resource Unit (irrigation service).

 

Article 3:

The secretary general enjoys a rank that is equivalent to Secretary of State. The vice-secretary general enjoys a rank that is equivalent to Under-secretary of State. Each unit is equivalent to public department and shall be managed by one officer.

 

Article 4:

The CARD shall have its executive committee in charge of management over day-to-day activities.

CARD’s executive committee shall be chaired by:

1)      CARD Chairman;

2)      CARD Vice-chairman;

3)      CARD Secretary General; and

4)      CARD Vice-secretary general.

 

CHAPTER 2: Roles and Responsibilities of CARD

 

Article 5:

The CARD shall function as a central mechanism assisting the Royal Government in agricultural and rural development through cooperation with relevant ministries/ institutions, in particularly, the Council for the Development of Cambodia, the Ministry of Agriculture, Forestry and Fisheries, the Ministry of Rural Development, the Ministry of Public Works and Transports, and the Ministry of Water Resource and Meteorology to ensure coherence and effectiveness and have the right to make decision over means, equipment, fund, and other activities which promote the achievements of tasks listed in Article 6.

 

Article 6:

The roles and responsibilities of CARD are as follows:

-          To manage, follow-up and provide consultation for implementation of government policies and national development and rehabilitation programs regarding agricultural and rural development in order to transform self-reliance agriculture into exportation production and to gradually reduce the gap between the rural and urban areas;

-          To define key measures for restoration and agricultural and rural development;

-          To set priority and policies for restoration and agricultural and rural development to be consistent with the royal government policies;

-          To motivate and facilitate public participation of i.e. private companies, rural communities, international and non-governmental organizations, ministries/ institutions, provinces/municipalities in order to expedite and coordinate the restoration and agricultural and rural development that ensure the sustainability of production and business, food security and reduce poverty at rural areas; and

-          To review, consult, and affect all requests made by ministries/institutions regarding restoration and agricultural and rural development. To report and request for recommendations of the Royal Government on major issues which are in the scope of government’s jurisdiction.

 

CHAPTER 3: The Functioning of CARD

 

Article 7:

The Chairman of CARD shall have the following roles and tasks:

-          To be responsible for CARD’s missions;

-          To preside at CARD meeting and Executive Committee meetings;

-          To moderate discussion and conclude decision of CARD meeting and Executive Committee meetings; and

-          To call an ordinary meeting or in case of emergency an extraordinary meeting of CARD and Executive Committee meeting.

 

Article 8:

The Vice-Chairman of CARD shall have the following roles and tasks:

-          To be responsible for overall CARD’s missions in absence of the chairman;

-          To be responsible for management and control over day-to-day activities;

-          To preside at CARD meeting and CARD Executive Committee meetings and sing the minutes and notice of CARD meetings;

-          To be in charge of inter-ministerial coordination among CARD and governmental ministries/institutions; and

-          To establish relationship with foreign partners for matters related to restoration and agricultural and rural development.

 

Article 9:

The roles and tasks the Secretary General of CARD are to:

-          Be responsible for management of CARD’s general secretariat;

-          Develop program and agenda and other documents for CARD meeting and Executive Committee meeting;

-          Prepare minutes, notices of CARD meeting, and meeting of Executive Committee for submission to the vice-chairman for signature;

-          Prepare CARD’s quarterly, semi-annual or annual reports;

-          Prepare CARD press release;

-          Attend meeting of CARD and Executive Committee meeting; and

-          Perform other tasks as designated by CARD chairman or vice chairman.

 

Article 10:

Each deputy secretary general shall perform tasks as designated by the Secretary General.

 

Article 11:

Each member shall have the following roles and duties:

-          To attend all ordinary meetings and extraordinary meetings of CARD to review and make decisions over proposal made by institutions concerning the restoration and agricultural and rural development;

-          Members, as directors of institutions whose missions associated with restoration and agricultural and rural development, have duties to develop political program, reports, measures, and send proposal to CARD for review and approval; and

-          To review and decide CARD’s quarterly, semi-annual or annual reports.

 

Article 12:

The CARD shall meet at least once every three months.

 

Article 13:

The CARD’s Executive Committee shall convene its ordinary meeting once every two weeks.

 

Article 14:

The CARD shall have the rights to invite the director, representative or advisors from any institutions if necessary to attend the CARD meeting or Executive Committee meeting.

 

Article 15:

The vice-chairman and secretary general of CARD shall have the rights to attend the plenary session of the Council of Ministers at the convention of the Council of Ministers.

 

Article 16:

All administrative activities, CARD expenses, salaries and wages of civil servants shall be borne by the Council of Ministers.

 

Article 17:

In case of emergency, the chairman of CARD may call extraordinary meetings of CARD and of the Executive Committee.

 

Article 18:

The conduct of meetings of CARD and of the Executive Committee and organization and functioning of the CARD shall determined by its internal regulations.

 

CHAPTER 4: Final Provisions

 

Article 19:

The CARD shall use the seal of the Council of Ministers.

 

Article 20:

Any previous Anukret or Decisions that are contrary to this Anukret shall be deemed abrogated.

 

Article 21:

The CARD and all relevant ministries/institutions and interested persons shall implement this Anukret from the date of signature.
