Cadre of Administrative Agents

-        Having seen Reach Kret No. NS/RKT/1198/72 of November 30, 1998 on the Appointment of the Royal Government of Cambodia;

-        Having seen Reach Kram No. 02/NS/94, dated July 20, 1994, promulgating the Law on the Organization and Functioning of the Council of Ministers;

-        Having seen Reach Kram No. 06/NS/94, dated October 26, 1994, promulgating the Law on Co-Statute of the Civil Servants of the ;

-        Having seen Reach Kram No. NS/RKM/0196/24, date January 24, 1996, promulgating the Law on Creation of State Secretariat for Public Service;

-        Having seen Reach Kret No. CS/RKT/1297/273 of December 1, 1997 on the General Principles for Organization of the Civil Service,

-        Pursuant to the approval of the Council of Ministers at its plenary session dated June 23, 2000,

 

HEREBY ORDERS

 

CHAPTER 1: General Provisions

 

Article 1:

To form a Cadre of Administrative Agents which shall be classified as Category D as stipulated in Article 6 of the Reach Kram No. CS/RKT/1297/273 of December 1, 1997 on the General Principles for Organization of Public Service.

 

Article 2:

This Cadre of Administrative Agents is governed by the particular statute for such cadre, and shall be under the auspices of the Secretariat of Civil Service which is in charge of designating civil servants to serve the administrative functions at various ministries and institutions. The promotion of civil servants shall be decided by their respective ministries/institutions.

 

No authority may create any cadre of administrative service other than the Cadre of Administrative Agents, except for the Ministry of Interior.

 

Article 3:

The Officers of the Administrative Agent Cadre shall be qualified to serve in executive positions at central, provincial, or municipal administrations and in public administrative institutions.

 

CHAPTER 2

The Rank and the Position

 

Article 4:

The cadre of the Administrative Agent consists of 3 ranks as follows:

 

-   Administrative Agent Officer comprising 6 grades

-          Principal Administrative Agent comprising 10 grades

-   Administrative Agent comprising 14 grades

 
CHAPTER 3

Recruitment

 

Article 5:

The recruitment of administrative agents shall be done through competitive examinations organized by the State Secretariat for Public Service and interested ministries from among the candidates who are from the civil service and/or graduates. The number of positions to be recruited for shall be determined by the Royal Government by proposal of the Secretariat of Public Service.

 

Article 6:

The competitive examination for graduates shall be organized for candidates who are 25 years of age as of the examination date. Such age may be extended from 25 years to 30 according to Article 11 of the Statute of Civil Servants.

 

CHAPTER 4

Preliminary Training and Appointment

 

Article 7:

A recruited candidate shall be required to complete a probationary training that shall be organized in accordance with Article 16 and subsequent Articles of the Statute of Civil Servants.

 

After the probationary training, the official shall be permanently appointed to the administrative agent rank, or in case of emergency, supplementary training may be authorized for a maximum period of 12 months. Any official who has not successfully completed the supplementary training shall be dismissed. Such cases shall be decided by Prakas of the Secretariat of Civil Service at the request of the interested ministry/institution by specifying reasons and shall be made no later than three months after the completion of probationary training. Appointment as a probationary administrative agent and permanent appointment to the rank of administrative agent shall be done by Prakas of the State Secretariat for Public Service.

 

CHAPTER 5

Appointment

 

Article 8:

After being appointed as an administrative agent, such administrative agent shall be appointed to any vacant position based on his/her position by Prakas of the respective ministry or institution under the procedure provided by Article 28 of July 20, 1994, promulgated by the Law on the Organization and Functioning of the Council of Ministers.

 

CHAPTER 6

Promotion of Rank and Title

 

Article 9:

An official of the administrative agent cadre shall be promoted pursuant to the conditions set forth in Article 20 subsequent Articles of the Law on Co-Statute of Civil Servants.

 

The basic qualifications that shall be observed in the promotion are as follows:

 

-        Proper respect for working policies;

-        Completion of work assignments; and

-        Good morality.

 

The promotion of civil servants shall be based on a proportion of three fourth (¾) of the recruitment cycle and one fourth (¼) seniority.

 

Article 10:

In principle, one rank shall be promoted to the next higher rank or, in case of emergency, to a rank parallel to the next equivalent salary index or to his/her previous index.

 

The promotion of rank shall apply in accordance with the availability of vacancies in such positions and shall be done in compliance with enrollment in promotion books or by competitive examination, or based on local or international long-term training:

 

-        Administrative Agent Officer = 5%

-        Principal Administrative Agent = 25%

-        Administrative Agent = 70%

 

The rank shall be promoted through a Prakas of the Secretariat for Civil Service.

 

Article 11:

Any officer who reaches Grade 11 of the Administrative Agent rank may be promoted to Principal Administrative Agent. Any Administrative Agent who reaches Grade 7 of the Principal Administrative Agent rank may be promoted to Administrative Agent Officer.

 

Article 12:

The salary index of each rank of the administrative agent and the unit value of index and other benefits shall be determined by a separate Royal Decree.

 

CHAPTER 7

Particular Provisions

 

Article 13:

Administrative agent officers shall retire at the age of 55 years.

Retirement shall be decided by Prakas of the State Secretariat for Public Service.

 

Article 14:

The initial set of administrative secretaries shall be constituted by an integration of officials who are currently serving in administrative positions and functions at the central and provincial/ municipal levels.

 

CHAPTER 8

Transitional Provisions

 

Article 16:

The Prime Minister of the Royal Government of Cambodia shall implement this Royal Decree from the date of signature herein.
